WELCOME AND INTRODUCTION OF GUESTS Elbra Wedgeworth welcomed the Board Members and guests to todays meeting. III. PUBLIC COMMENT President Wedgeworth asked for public comment. There was no public comment. IV. ROLL CALL Dawn Bookhardt called roll. Please see above. V. APPROVAL OF MEETING MINUTES Elbra Wedgeworth asked for comments to the November 3, 2011 meeting minutes. There were no comments. Jerry Glick moved to approve the minutes. Kent Bagley seconded the motion. The motion carried unanimously. VI. DISCUSSION ITEMS A. Finance Committee Report None. B. Owners Representative Report i) Project Progress Mike Sullivan reported that as of the end of November, 2011, the completion percentages were as follows: Entire project is just over 50 percent complete LRT is 99 percent complete Bus Facility is just over 49 percent complete The CRT is 36.5 percent complete The Streets and Plazas are 30.5 percent complete Mr. Sullivan reported that Kiewit has completed $156 million in work and that $15.6 in retainage is being withheld. He reported that the schedule now shows the middle of May 2014 as the completion date and that the schedule was pushed back from the mid-April contractual completion date due to the dewatering issues and a delay by Xcel Energy in moving a duct bank. Mr. Sullivan reported that the Bus Facility is still the critical path and that the caissons and pier caps are being installed but that the installation of the mud mat in bottom of the excavation has been delayed due to the snow. He reported that the as-built drawings for the LRT are still being generated. He reported that in one week the south row of parking spaces will be closed in the parking lot by 16th Street and that in mid-December all of the parking lots in front of the DUS will close. He reported that today is the twelfth weather day of the project out of 45 days that are budgeted. He reported that he now has less concern with the project budget than with the project schedule and that he really has no concerns with project schedule. Mr. Sullivan reported that the DUS has not settled at all in conjunction with the excavation for the bus facility and that this risk appears to be mitigated. He reported that there is still a risk of encountering contaminated soil when excavation for the CRT grade change occurs, otherwise the soils risks are over. He added that, to our knowledge, all ACM has been removed. He reported that the hearing with the State Water Quality Commission will take place. He reported that the next budget should show that there are minimal remaining risks with the project. Mr. Sullivan reported that the pedestrian bridge design will be issued the third week of January, 2012 and that the remaining design issues are small. He reported that mechanical, electrical and plumbing are being installed in the bus facility. He reported that Phase 3 of the project is east of Wewatta Street, that waterproofing is being applied and that the elevator and escalator foundations deep in the bus facility excavation are being installed. He reported that the CRT area work is still only the bus facility and some sewer work. He reported that, at the LRT, the aggregate base course is still needed as the base for the concrete pavers. He reported that Denver Water decided that it wanted different valves and flanges and that the ones that were installed needed to be changed. Bill Bianco asked whether the delays that have occurred will require Kiewit to accelerate to recover the time. Mr. Sullivan responded that this issue has not been worked out with Kiewit yet. Bill Mosher added that DUSPA does not intend to pay Kiewit even though they are owed the time. Elbra Wedgeworth asked for more detail on the Water Quality Control Commission hearing. Mike Sullivan responded that it is an emergency rule making hearing. Jim Paulmeno added that if the Commission agrees that the standards are too strict, the new rule will be immediately reversed. ii) Project Issues List Bill Mosher reported the following from the corresponding DUSPA Issues List: There is a portion of the mail tunnel still in place that DUSPA may have to remove the tunnel and that it will have ACM. The hearing is at 8:30 a.m. at the CDPHE The PSAs are in RTDs hands and DUSPA has voiced its issues with the deposits being refundable and the environmental language. Two of the three transactions are complete and the third is in progress. The Artist contract is in progress. DUSPA is waiting for the process to manifest for the Tail Tracks plaza. DUSPA is waiting for a developer to be selected. Discussions for the fourth MOU are in progress. No change. The maintenance issue needs to be resolved. Good. Good. Drawings should be ready this week and the review and comment period will begin. Kent Bagley reported that he understands that a bike facility is contemplated for the Tail Tracks plaza and inquired as to who will construct the facility. Bill Mosher responded that USNC and the Metro District will construct the facility. He added that funds must be raised, they will design the facility and DUSPA will then review and approve the plans for the facility. He also added that DUSPA has just under $1 million budgeted for the surface improvements at this plaza. Frank Cannon reported that USNC and the Metro District will build the structures and the DUSPA will pay for the surface improvements. iii) Proposed Change Orders CM 31.1 Mr. Mosher reported that this change order is appropriate because the under-build should be constructed prior to and in conjunction with the CRT canopy rather than after the canopy is constructed. Barbara Grogan asked whether the price of $455,297 is final. Mr. Mosher reported that it was a final price, that DUSPA had $700,000 budget for this work and that he is pleased with the price. CM 479 Mr. Mosher reported that DUSPA really has no choice and that we need to agree to the price of the Bus Facility sealant. CM 592 the Denver Fire Department is requiring this work. CM733 this change order is an enhancement to the DUS and that the funds are available in the budget. Mr. Mosher recommended approval of CM 265.4, 445, 653.1 and 724 for RTD / DTP. Mr. Mosher reported that he anticipates that DUSPA should be done with change orders in about four months. C. Parking Lot Closure Roger Sherman of CRL Associates provided a hand out of the Denver Union Station Project Update. He reported that the work on the east side of the DUS will cause an impact to the public and that CRL has conducted many public meetings to inform the public. He added that informational flyers will be distributed next week. Mr. Sherman reported that a catch all public meeting will occur at RTD on December 15 and that the public outreach program for the parking lots has been very aggressive. Judy Montero asked what types of questions are being received from the public. Mr. Sherman responded that people are mostly curious about the dates of the closure events. Dawn Bookhardt asked whether there is a plan to provide alternative parking information. Roger Sherman reported that there was no plan for DUSPA to provide this information but that Central Parking, who manages the parking lots, is handling its monthly parking customers. Bill Mosher added that Laura Aldrete reviewed the public outreach plan with DUSPA and CRL in advance. VII. ACTION ITEMS A. Proposed Change Orders Jerry Glick made a motion to approve the nine proposed change orders on todays Pending Change Order Items Requiring Board Approval list. Kent Bagley seconded the motion. Steve Kaplan abstained from voting on the motion because Change Order CM 31.1 pertains to the Block A & B under-build. The vote to approve the change orders was unanimous. VIII.
